Apt Garden Creations Limited is a New Zealand based business and all prices on our website are in New Zealand dollars. The goods for sale on this website are intended only for people living in New Zealand, and you will only be able to enter a New Zealand based address for billing and shipping. These Terms are governed by New Zealand law. This extends to contracts between you and us for the purchase of goods, and any disputes or claims arising from these contracts. By agreeing to our Terms, you agree that all matters or disputes connected to this website will be dealt with in New Zealand courts.

Placing an Order

By placing your order, you agree that these Terms will apply to any sales contract between us; and confirm that you have read and understood them and agree to be bound by them.

Unfortunately, we are unable to guarantee that all details, including product descriptions and images on our website, are correct at the time of publishing.

Regarding images, we cannot guarantee that your computer monitor’s display of any colour will be accurate. The products you receive may vary slightly from these images and descriptions.

All products are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available. Product information and availability is subject to change without notice.

Prices

Prices for our products may change from time to time. Price changes will not affect any orders which we have confirmed (through dispatch confirmation – as mentioned under “Placing an order”).

Despite our best efforts, there is always the small possibility that some of our products on our website may have an incorrect price. If we do find an error with a price, we will update that price immediately. In this situation, there is a pricing error on a product you have ordered, we will contact you in writing (through email) of this error before accepting your order. If the products correct price is lower than the purchase price, you will be charged the lower price. If the correct price is higher than the purchase price, then we reserve the right to change the price. You will then have the option of continuing the purchase at the correct price or cancelling the order. In any case, we will wait for your instruction before proceeding.

Nationwide Delivery

Once dispatched you are responsible for ensuring the prompt collection from the transport company depot that was instructed by you to deliver to. Delays in picking up your item may incur additional fees made by the transport provider. You are liable for all additional fees incurred and exempt Apt Garden Creations from these fees.

You have 5 Business days once dispatched to notify us of any collection/dispatch problems.

Limitation of Liablity

To the extent permitted by law:

– Apt Garden Creations Limited disclaims all warranties, representations, and guarantees with respect to any product or information supplied, including but not limited to; fitness for a particular purpose, accuracy, availability, timeliness, or completeness.

Discount Codes

– Only one discount code can be used per order.
– Discount codes can be used on products that are already on sale.

– Discounts codes may have an expiry date. Orders placed outside these dates will be sold at full price.
